FAMILY AND MEDICAL LEAVE ACT (FMLA): Any employee who has been employed on a one-half time basis or greater for at least twelve consecutive months is eligible for up to twelve weeks of family leave under conditions authorized by the Family and Medical Leave Act. FMLA is unpaid leave; however, an employee must use all accrued paid leave balances (including sick leave and vacation) while taking family and medical leave, unless the employee is receiving temporary disability benefit payments or workers’ compensation benefits. Family leave shall be granted to an eligible employee in the event of birth of the child of the employee, placement of a child with the employee for adoption, a serious health condition of the employee’s child, spouse, parent or spouses’ parent necessitating the employee’s presence, or a serious health condition of the employee which renders him/her unable to perform the duties of his/her job. With certain exceptions, FMLA entitles the employee to be restored to the position held prior to going on leave or to an equivalent position. Family leave allows the employee to maintain his/her employee benefits during the period of leave with institutional participation in the payment of premiums. Family leave must be requested on a Family Leave Request Form and submitted to the Office of Human Resources & Services via appropriate administrative officers.

MATERNITY: Disability due to pregnancy shall be considered as any other disability and sick leave provisions will apply.

COURT DUTY: Employees of the University called for jury duty or witness duty will be paid by the University at the normal rate of pay for any regularly scheduled time lost from the job. This leave will be granted upon presentation of official orders from the appropriate court. A court seldom requires full-time attendance; an employee is expected to return to work whenever he or she is not required to be present in court.

VOTING: Employees, upon written request, may be granted up to two hours time off to vote if their workday begins at least two hours before polls open or ends at least two hours after polls close.

MILITARY: Military duty shall include any ordered duty in the service of the State or the United States, and service schools conducted by the U.S. armed forces. Such duty must be performed for a period or periods not exceeding a total of thirty (30) days in any one calendar year. Regular employees shall be entitled to leave with pay while engaged in the performance of military duty and while going to and from such duty. The maximum length of military leave with pay shall be eighteen (18) working days in any one calendar year. At the expiration of the maximum paid leave time continued absence by the employee shall be considered as military leave without pay. The employee will be requested to submit a copy of his or her orders to active duty. Not withstanding the foregoing limitation, in the event the Governor declares an emergency and orders an employee to State active duty as a member of the National Guard, the employee will be paid his or her salary for a period not exceeding thirty (30) days in any one continuous period of State active duty. Any regular employee required by Federal Law to take a selective service or military physical examination shall be paid for any time lost to take such examinations. Military leave without pay shall be granted when a regular employee enlists, or is ordered to active service with any branch of the armed forces of the United States for the initial period of such service. Upon completion of active service the employee shall be restored to his or her former position or at the discretion of the institution to one of similar status with all privileges of accumulated seniority, salary increases, etc., provided he or she receives an honorable discharge and if he or she requests reinstatement within 90 days after discharge or separation from active duty.

EDUCATION LEAVE WITHOUT PAY: CSU may grant educational leave without pay to full-time employees for periods not to exceed one year at a time for the purpose of encouraging professional development. Such approved leave shall allow the employee the right to elect to continue group insurance benefits with institutional participation.

OTHER LEAVE: The President of CSU may approve personal leaves of absence without pay for periods not to exceed one year. Requests will be considered on an individual basis upon the recommendation of the supervisor, the Provost and the Vice President of Operations, Planning & Budgets. Personal leave may be granted only when conditions permit. In the event of inclement weather or emergency, the President may declare leave with or without pay.
